(\u010falej len \u201eTCS\u201c), ktor\u00fa je povinn\u00fd dodr\u017eiava\u0165 z h\u013eadiska etiky spolo\u010densk\u00e9ho styku s ob\u010danmi, pr\u00e1vnick\u00fdmi osobami a ostatn\u00fdmi zamestnancami. Cie\u013eom etick\u00e9ho k\u00f3dexu je stanovi\u0165 z\u00e1kladn\u00e9 z\u00e1sady a pravidl\u00e1 spr\u00e1vania sa zamestnanca a vytv\u00e1ra\u0165 tak z\u00e1klad pre udr\u017eiavanie d\u00f4very verejnosti vo v\u00fdkon verejnej spr\u00e1vy.<\/p>\n<p>Zamestnanec m\u00e1 z\u00e1ujem podie\u013ea\u0165 sa na spravodlivom a efekt\u00edvnom v\u00fdkone verejnej spr\u00e1vy prostredn\u00edctvom riadneho plnenia si zveren\u00fdch \u00faloh a zvy\u0161ovania si odborn\u00fdch znalost\u00ed.<\/p>\n<p>\u010cL 1<\/p>\n<p><strong>Z\u00e1sady spr\u00e1vania zamestnanca pri v\u00fdkone pr\u00e1ce vo verejnom z\u00e1ujme<\/strong><\/p>\n<p>Zamestnanec TCS (\u010falej len ako \u201ezamestnanec\u201c) je pri plnen\u00ed pracovn\u00fdch povinnost\u00ed povinn\u00fd postupova\u0165 v s\u00falade so z\u00e1sadou:<\/p>\n<ol>\n<li>z\u00e1konnosti,<\/li>\n<li>ochrany verejn\u00e9ho z\u00e1ujmu,<\/li>\n<li>nestrannosti a politickej neutrality,<\/li>\n<li>z\u00e1kazu prij\u00edmania darov,<\/li>\n<li>profesionality,<\/li>\n<li>d\u00f4stojnosti a slu\u0161n\u00e9ho spr\u00e1vania, g) rovnak\u00e9ho zaobch\u00e1dzania.<\/li>\n<\/ol>\n<p>\u010cL 2<\/p>\n<p><strong>Z\u00e1sada z\u00e1konnosti<\/strong><\/p>\n<p>Zamestnanec vykon\u00e1va svoje \u00falohy v s\u00falade s \u00dastavou SR, z\u00e1konmi, ostatn\u00fdmi v\u0161eobecne z\u00e1v\u00e4zn\u00fdmi pr\u00e1vnymi predpismi, intern\u00fdmi predpismi zamestn\u00e1vate\u013ea a ustanoveniami tohto k\u00f3dexu.<\/p>\n<p>\u010cI. 3<\/p>\n<p><strong>Z\u00e1sada ochrany verejn\u00e9ho z\u00e1ujmu<\/strong><\/p>\n<p>Zamestnanec:<\/p>\n<ul>\n<li>kon\u00e1 v\u017edy vo verejnom z\u00e1ujme,<\/li>\n<li>nez\u00fa\u010dast\u0148uje sa \u017eiadnej \u010dinnosti, ktor\u00e1 by mohla by\u0165 v rozpore s plnen\u00edm jeho pracovn\u00fdch povinnost\u00ed, alebo ktor\u00e1 je nezlu\u010dite\u013en\u00e1 s riadnym v\u00fdkonom jeho pracovn\u00fdch povinnost\u00ed,<\/li>\n<li>zdr\u017eiava sa konania, ktor\u00e9 by viedlo ku konfliktu verejn\u00e9ho z\u00e1ujmu s osobn\u00fdmi z\u00e1ujmami zamestnanca a jemu bl\u00edzkych os\u00f4b,<\/li>\n<li>je povinn\u00fd vyhn\u00fa\u0165 sa tak\u00e9muto konfliktu a z\u00e1rove\u0148 predch\u00e1dza\u0165 situ\u00e1ci\u00e1m, ktor\u00e9 m\u00f4\u017eu vyvola\u0165 podozrenie z konfliktu z\u00e1ujmov,<\/li>\n<li>je povinn\u00fd efekt\u00edvne naklada\u0165 s verejn\u00fdmi zdrojmi.<\/li>\n<\/ul>\n<p>\u010cI. 4<\/p>\n<p><strong>Z\u00e1sada nestrannosti a politickej neutrality<\/strong><\/p>\n<p>Zamestnanec:<\/p>\n<ul>\n<li>je povinn\u00fd sa zdr\u017ea\u0165 takej politickej alebo inej verejnej anga\u017eovanosti, ktor\u00e1 by nar\u00fa\u0161ala d\u00f4veru verejnosti v nestrann\u00fd v\u00fdkon pracovn\u00fdch povinnost\u00ed,<\/li>\n<li>postupuje pri plnen\u00ed svojich \u00faloh nestranne a transparentne. Rozhoduje na z\u00e1klade riadne zisten\u00e9ho skutkov\u00e9ho stavu veci, pri\u010dom d\u00f4sledne db\u00e1 na rovnos\u0165 \u00fa\u010dastn\u00edkov tak, aby nedoch\u00e1dzalo k ujm\u00e1m na ich pr\u00e1vach a opr\u00e1vnen\u00fdch z\u00e1ujmoch a vyh\u00fdba sa konaniu, ktor\u00e9 by mohlo ohrozi\u0165 d\u00f4veru verejnosti v nestrannos\u0165 a objektivitu rozhodovania,<\/li>\n<li>je povinn\u00fd kona\u0165 v s\u00falade s cie\u013emi a \u00falohami zamestn\u00e1vate\u013ea, pri\u010dom sa nesmie da\u0165 ovplyvni\u0165 z\u00e1mermi in\u00fdch os\u00f4b, ani prija\u0165 ak\u00fako\u013evek finan\u010dn\u00fa alebo in\u00fa v\u00fdhodu, ktor\u00e1 by mohla ma\u0165 vplyv na riadny v\u00fdkon jeho pracovn\u00fdch povinnost\u00ed a v\u00fdsledok rozhodovania.<\/li>\n<\/ul>\n<p>\u010cI. 5<\/p>\n<p><strong>Z\u00e1sada z\u00e1kazu prij\u00edmania darov<\/strong><\/p>\n<p>Zamestnanec:<\/p>\n<ul>\n<li>nevy\u017eaduje ani neprij\u00edma dary, \u00fasluhy ani in\u00e9 pozornosti, ktor\u00e9 by mohli ma\u0165 vplyv na jeho rozhodovanie a profesion\u00e1lny pr\u00edstup vo veci, alebo ktor\u00e9 by bolo mo\u017en\u00e9 pova\u017eova\u0165 za odmenu za pr\u00e1cu, ktor\u00e1 je jeho povinnos\u0165ou. Darom sa rozumie nepe\u0148a\u017en\u00e9 plnenie alebo ak\u00e1ko\u013evek in\u00e1 nepe\u0148a\u017en\u00e1 v\u00fdhoda poskytnut\u00e1 zamestnancovi pri v\u00fdkone jeho funkcie, alebo v priamej s\u00favislosti s plnen\u00edm jeho pracovn\u00fdch \u00faloh. Za dar sa nepova\u017euje nepe\u0148a\u017en\u00e9 plnenie nepatrnej hodnoty, ktor\u00e9ho poskytnutie je v danej situ\u00e1cii obvykl\u00e9 a ktor\u00e9ho \u00fa\u010delom nie je bez ak\u00fdchko\u013evek pochybnost\u00ed ovplyvni\u0165 konanie alebo rozhodovanie zamestnanca pri plnen\u00ed svojich pracovn\u00fdch povinnost\u00ed.<\/li>\n<li>nezneu\u017e\u00edva v\u00fdhody plyn\u00face z jeho postavenia ani inform\u00e1cie z\u00edskan\u00e9 pri plnen\u00ed pracovn\u00fdch \u00faloh pre z\u00edskanie ak\u00e9hoko\u013evek osobn\u00e9ho majetkov\u00e9ho, \u010di in\u00e9ho prospechu.<\/li>\n<\/ul>\n<p>\u010cI. 6<\/p>\n<p><strong>Z\u00e1sada profesionality<\/strong><\/p>\n<p>Zamestnanec:<\/p>\n<ul>\n<li>chr\u00e1ni majetok pred po\u0161koden\u00edm, zneu\u017eit\u00edm a zni\u010den\u00edm. Zveren\u00e9 prostriedky vyu\u017e\u00edva \u010do najefekt\u00edvnej\u0161ie, v s\u00falade s \u00fa\u010delom, na ktor\u00fd boli ur\u010den\u00e9 a nezneu\u017e\u00edva ich na dosiahnutie osobn\u00e9ho prospechu,<\/li>\n<li>je povinn\u00fd zachov\u00e1va\u0165 ml\u010danlivos\u0165 o skuto\u010dnostiach, o ktor\u00fdch sa dozvedel pri plnen\u00ed svojich \u00faloh a ktor\u00e9 v z\u00e1ujme zamestn\u00e1vate\u013ea nemo\u017eno oznamova\u0165 in\u00fdm osob\u00e1m, a to ani po skon\u010den\u00ed pracovn\u00e9ho pomeru,<\/li>\n<li>zachov\u00e1va a posil\u0148uje dobr\u00e9 meno zamestn\u00e1vate\u013ea a to tak na pracovisku, ako aj mimo neho. Kon\u00e1 tak, aby nebola naru\u0161en\u00e1 d\u00f4vera verejnosti vo\u010di zamestn\u00e1vate\u013eovi,<\/li>\n<li>je povinn\u00fd plni\u0165 si svoje \u00falohy svedomito a zodpovedne, v dobrej viere a v zhode s poslan\u00edm zamestn\u00e1vate\u013ea. V\u00fdkon pr\u00e1ce mus\u00ed by\u0165 spojen\u00fd s maxim\u00e1lnou mierou slu\u0161nosti, porozumenia a ochoty,<\/li>\n<li>usiluje sa o zjednodu\u0161enie procesn\u00fdch postupov a ur\u00fdchlenie leh\u00f4t na plnenie \u00faloh alebo vydanie rozhodnutia.<\/li>\n<\/ul>\n<p>\u010cI. 7<\/p>\n<p><strong>Z\u00e1sada d\u00f4stojnosti a slu\u0161n\u00e9ho spr\u00e1vania<\/strong><\/p>\n<p>Zamestnanec:<\/p>\n<ul>\n<li>si v\u00e1\u017ei ka\u017ed\u00e9ho ob\u010dana a spr\u00e1va sa tak, aby v\u0161etky n\u00e1v\u0161tevy u zamestn\u00e1vate\u013ea vn\u00edmali, \u017ee s\u00fa v\u00edtan\u00e9 a zamestnanci s\u00fa tu pre nich. Pom\u00e1ha zorientova\u0165 sa ob\u010danovi v priestoroch zamestn\u00e1vate\u013ea, pr\u00edpadne ho nasmeruje k cie\u013eu jeho n\u00e1v\u0161tevy. Vo\u010di verejnosti vystupuje zdvorilo a s \u00factou, nie je v\u0161ak povinn\u00fd tolerova\u0165 vulg\u00e1rne prejavy a ur\u00e1\u017eky a kona\u0165 s osobami, ktor\u00e9 nedodr\u017euj\u00fa z\u00e1kladn\u00e9 pravidl\u00e1 slu\u0161n\u00e9ho spr\u00e1vania,<\/li>\n<li>re\u0161pektuje rozhodnutia svojich nadriaden\u00fdch a v pr\u00edpade v\u00fdhrad dodr\u017eiava \u00faradn\u00fd pr\u00edstup a rie\u0161i ich najsk\u00f4r s pr\u00edslu\u0161n\u00fdm nadriaden\u00fdm,<\/li>\n<li>si v\u00e1\u017ei a re\u0161pektuje ostatn\u00fdch zamestnancov a ich pr\u00e1cu, ktor\u00e1 je rovnako d\u00f4le\u017eit\u00e1 ako t\u00e1 jeho a vyvaruje sa tak\u00e9ho konania, ktor\u00e9 by mohlo by\u0165 ozna\u010den\u00e9 ako tzv. mobbing (opakovan\u00e9 nezmierite\u013en\u00e9 \u00fatoky na sebad\u00f4veru a sebahodnotenie \u013eud\u00ed, \u0161ikana, apod.) alebo ako tzv. bossing (\u0161ikanovanie podriaden\u00e9ho zamestnanca nadriaden\u00fdm),<\/li>\n<li>pom\u00e1ha nov\u00fdm zamestnancom v procese ich adapt\u00e1cie,<\/li>\n<li>uvedomuje si, \u017ee navonok aj dovn\u00fatra reprezentuje zamestn\u00e1vate\u013ea, a preto chod\u00ed do pr\u00e1ce upraven\u00fd, oble\u010den\u00fd v s\u00falade so spolo\u010denskou etiketou, pri\u010dom re\u0161pektuje po\u017eiadavky zamestn\u00e1vate\u013ea. Vzbudzuje na pracovisku \u010do najlep\u0161\u00ed dojem, \u010do sa d\u00e1 docieli\u0165 pr\u00edjemn\u00fdm a profesion\u00e1lnym vystupovan\u00edm a dodr\u017eiavan\u00edm z\u00e1sady spr\u00e1vneho spolo\u010densk\u00e9ho vystupovania,<\/li>\n<li>vyh\u00fdba sa tak\u00e9mu spr\u00e1vaniu a \u010dinnostiam, ktor\u00e9 by mohli zn\u00ed\u017ei\u0165 d\u00f4veru v nestrann\u00fd v\u00fdkon verejnej spr\u00e1vy.<\/li>\n<\/ul>\n<p>\u010cI. 8<\/p>\n<p><strong>Z\u00e1sada rovnak\u00e9ho zaobch\u00e1dzania<\/strong><\/p>\n<p>Zamestnanec je povinn\u00fd dodr\u017eiava\u0165 z\u00e1sadu rovnak\u00e9ho zaobch\u00e1dzania, upraven\u00fa v osobitnom pr\u00e1vnom predpise.<\/p>\n<p>\u010cI. 9<\/p>\n<p><strong>Oznamovacia povinnos\u0165 v s\u00favislosti s poru\u0161en\u00edm Etick\u00e9ho k\u00f3dexu<\/strong><\/p>\n<p><strong><u>Zamestnanec je povinn\u00fd v s\u00favislosti s v\u00fdkonom svojej pr\u00e1ce bezodkladne ozn\u00e1mi\u0165 svojmu priamemu nadriaden\u00e9mu pr\u00edpady:<\/u><\/strong><\/p>\n<ul>\n<li>konfliktu z\u00e1ujmov, resp. nemo\u017enosti vyhn\u00fa\u0165 sa konfliktu z\u00e1ujmov,<\/li>\n<li>ak je po\u017eiadan\u00fd, aby konal v rozpore s pr\u00e1vnymi predpismi alebo etick\u00fdm k\u00f3dexom,<\/li>\n<li>zistenia straty alebo po\u0161kodzovania verejn\u00e9ho majetku, podvodn\u00e9ho alebo korup\u010dn\u00e9ho konania,<\/li>\n<li>vulg\u00e1rnych \u00fatokov smeruj\u00facich vo\u010di jeho osobe alebo vo\u010di org\u00e1nu verejnej spr\u00e1vy alebo pr\u00edpady konania osobami pod vplyvom n\u00e1vykov\u00fdch l\u00e1tok,<\/li>\n<li>pon\u00fakanie akejko\u013evek v\u00fdhody, ktor\u00e1 by mohla ma\u0165 ne\u017eiaduci vplyv na jeho rozhodovanie.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>V pr\u00edpade, \u017ee podozrenie z poru\u0161enia Etick\u00e9ho k\u00f3dexu smeruje vo\u010di priamemu nadriaden\u00e9mu, zamestnanec ozn\u00e1mi t\u00fato skuto\u010dnos\u0165 \u0161tatut\u00e1rnemu org\u00e1nu zamestn\u00e1vate\u013ea.<\/p>\n<p>V pr\u00edpade, \u017ee priamy nadriaden\u00fd je z\u00e1rove\u0148 \u0161tatut\u00e1rnym org\u00e1nom zamestn\u00e1vate\u013ea, zamestnanec ozn\u00e1mi podozrenie z poru\u0161enia Etick\u00e9ho k\u00f3dexu riadite\u013eovi \u00daradu TTSK.<\/p>\n<p>\u010cI. 10<\/p>\n<p><strong>Z\u00e1vere\u010dn\u00e9 ustanovenie<\/strong><\/p>\n<p>V tomto etickom k\u00f3dexe sa pou\u017e\u00edva jednotn\u00e9 rodov\u00e9 ozna\u010denie pre zjednodu\u0161enie textu.
